1. Your Right of Withdrawal

As a consumer shopping online within the European Union, you have the legal right to withdraw from your purchase within 14 calendar days from the day you (or a third party designated by you, other than the carrier) receive the goods. You do not need to provide a reason for exercising this right.

  • How to Exercise Your Right: To return an item, please notify us within the 14-day period by contacting us at info@pokecollect.eu. After notifying us, you must return the goods within 14 days of informing us of your decision to withdraw.

  • Return Costs: You are responsible for the direct costs of returning the goods unless we have explicitly agreed otherwise.

2. Conditions for Returns – Sealed Pokémon Products

Given the nature of our products, particularly Pokémon boxes (e.g., Booster Boxes, Elite Trainer Boxes), which are prone to resealing or tampering, we have specific conditions to ensure fairness and product integrity:

  • Unopened and Sealed Requirement: Returns are only accepted if the product remains completely unopened with the original factory seal intact. This means the plastic wrap or seal applied by the manufacturer must not be broken, torn, or otherwise tampered with. This condition helps us guarantee that returned items are in the same condition as when they were shipped and can be resold as new.

  • Reason for This Rule: Pokémon boxes contain randomized packs or cards, and opening them could allow the contents to be altered (e.g., removing valuable packs or cards). By requiring the seal to remain intact, we protect both our business and future customers from receiving compromised products.

  • Inspection Upon Return: All returned items will be inspected upon receipt. If the seal is broken or the product shows signs of tampering, use, or damage beyond what is necessary to verify its nature, we reserve the right to refuse the return or reduce the refund amount to reflect any diminished value (see Section 4 below).

3. Refund Process

Once we receive and inspect your returned item, we will notify you of the approval or rejection of your refund:

  • Full Refund: If the product meets our return conditions (unopened, sealed, and undamaged), we will refund the full purchase price, including the original shipping costs (if applicable), within 14 days of receiving the return. The refund will be issued using the same payment method you used for the purchase unless otherwise agreed.

  • Timing: We may withhold the refund until we have received the goods or until you provide proof of shipment, whichever comes first.

4. Exceptions and Diminished Value

  • Testing the Product: You may handle and inspect the product as you would in a physical store to verify its nature, characteristics, and functioning. However, any handling beyond this (e.g., breaking the seal or opening the box) may result in liability for diminished value. If the product is returned with a broken seal or in a condition that prevents us from reselling it as new, we may deduct a reasonable amount from your refund to account for this loss in value.

  • Non-Returnable Items: The right of withdrawal does not apply to certain items, such as:

    • Goods that have been customized or made to your specifications.

    • Sealed goods that are not suitable for return due to health or hygiene reasons if unsealed after delivery (though this typically does not apply to Pokémon boxes unless specified).

5. Faulty or Incorrect Items

If you receive a defective product, a product that doesn’t match the description, or the wrong item, please contact us immediately at info@pokecollect.eu. In such cases:

  • We will cover the return shipping costs.

  • You may choose a replacement (if available) or a full refund, regardless of the seal’s condition, as this falls under your legal guarantee rights (minimum 2 years under EU/Belgian law).

6. How to Return an Item

  2. Pack the item securely in its original packaging, ensuring the seal remains intact.

  3. Ship the item to our adres with a tracking service (we recommend retaining proof of shipment).

  4. Once received and approved, we’ll process your refund as outlined above.
